These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Trainexx Team, the owner and operator of www.trainexx.com ("Website," "Company," "we," "us," or "our").

By accessing our Website or using our AI-powered health consultancy, nutrition coaching, and wellness assessments (collectively, "Services"), you agree to be bound by these Terms.

2.1. AI-Driven Guidance: Trainexx provides wellness insights powered by Artificial Intelligence (AI). These insights are generated based on the data you provide and are intended for educational and informational purposes only. 

2.2. No Medical Diagnosis: Our AI and consultants do not provide medical diagnosis, clinical treatment plans, or prescriptions. Our Services are not a substitute for professional medical advice. 

2.3. AI Limitations: You acknowledge that AI-generated reports may occasionally contain inaccuracies. You agree to verify all AI-generated health suggestions with a Registered Medical Practitioner (RMP) before implementation.

3.1. Not for Emergencies: Our Services are NOT for medical emergencies. If you are experiencing chest pain, shortness of breath, or any acute health crisis, call 112 (or local emergency services) immediately. 

3.2. Consult Your Physician: Always seek the advice of a physician before starting any new diet or exercise program, especially if you have pre-existing conditions, are pregnant, or are nursing. 

3.3. Assumption of Risk: You voluntarily assume all risks associated with dietary changes or physical activities recommended through the platform.

4.1. You must be at least 18 years of age. Minors may only use the Services under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms. 

4.2. You are responsible for maintaining the confidentiality of your account and are liable for all activities occurring under your credentials.

5.1. Fees: All fees are payable in advance and are inclusive of applicable GST, unless stated explicitly on payment page or in plan description. Additonal chanrges may apply as per description stated on mentioned pages or herewithin other clauses of Terms & Conditions.

5.2. Refund Policy: * Coaching Packages: A full refund (less a [₹500] administrative fee) is available if requested within 7 days of purchase, provided no consultation has occurred.

• Digital Reports/Assessments: If applicable, Fees for one-time AI-generated health reports and on-time coach consultation sessions are strictly non-refundable.

• Coach Change: If you are unsatisfied with a human consultant, you may request a one-time change within the first 14 days of your program. 

5.3. Processing: Approved refunds will be credited to the original payment method within 7-10 working days.

6.1. Data Collection: We collect health metrics, dietary habits, and personal identifiers to provide personalized Services. 

6.2. AI Model Training: By using this Website, you grant Trainexx a non-exclusive, perpetual, royalty-free license to use your anonymized and de-identified data for the purpose of training, testing, and improving our AI models and algorithms. 

6.3. Data Security: We employ industry-standard encryption (AES-256) to protect your data. We do not sell your personal health information to third-party marketing or insurance firms. 

6.4. User Rights: You have the right to access, correct, or request the erasure of your personal data, subject to statutory record-keeping requirements under Indian law.

7.1. Ownership: All content, including AI algorithms, diet charts, workout modules, and Website code, is the exclusive property of the Company. 

7.2. Fair Use: You are granted a limited license for personal, non-commercial use. You shall not:

• Use automated bots or scrapers to extract data from our Website.

• Share, resell, or publicly redistribute Trainexx proprietary health plans.

• Circumvent any security or technological measures on the platform. 

7.3. Usage Limits: We reserve the right to throttle or suspend accounts that exhibit excessive usage patterns (e.g., bot-like behavior) that exceed the fair usage average of our user base.

8.1. To the maximum extent permitted by law, Trainexx and its directors, employees, or AI developers shall not be liable for any indirect, incidental, or consequential damages arising from:

• Errors or inaccuracies in AI-generated content.

• Personal injury or health complications resulting from the use of our Services.

• Technical interruptions or data loss beyond our reasonable control.

You agree to indemnify and hold the Company harmless from any claims, losses, or legal fees arising out of your breach of these Terms, your provision of false medical data, or your violation of any third-party rights.

10.1. These Terms are governed by the laws of the Republic of India. 

10.2. Any disputes shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
